Innate Therapeutics Receives Funding for Clinical Trial of Progressive Multiple Sclerosis Therapeutic |
| Innate Therapeutics today announced funding support from Fast Forward, LLC, a not-for-profit organization established by the U.S. National Multiple Sclerosis Society and EMD Serono, an affiliate of Merck KGaA, Darmstadt, Germany. The award of funds will help support the conduct of a Phase 2A clinical trial in patients with progressive forms of MS using MIS416, a naturally occurring agent derived from bacteria. “We are delighted to gain this substantial funding as well as to be able to work with Fast Forward and their collaborative partner, EMD Serono,” said Simon Wilkinson, the Chief Executive Officer of Innate Therapeutics. Treatment of Multiple Sclerosis patent lodged |
| Innate Therapeutics has today filed a further patent application relating to the company's microparticle immune stimulator "platform". The patent claims the therapautic use of MIS416, the lead drug candidate developed off the platform, in the treatment of Multiple Sclerosis. The claims made in the application in part reflect the results the company has seen in a small group of patients with the progressive form of MS who have been treated on a compassionate basis under Section 25 of the New Zealand Medicines Act. |

Ministry of Health Grants Innate Therapeutics License to Manufacture MIS416 as Human Therapeutic

| The New Zealand Ministry of Health (MedSafe) has added MIS416 to the company's existing license to manufacture medicines. This confirms that MIS416 is being manufactured to the stringent requirements of cGMP, a requirement of any agent entering into human trials. The Company (formerly named Virionyx Corporation) is one of only a very small number of companies licensed by the New Zealand Government to manufacture medicines. |

NZ Shareholders Exempt Capital Gains Tax |
Earlier this year (2006), the New Zealand Government announced its intention to introduce a capital gains tax (or equivalent) on New Zealanders who invest in offshore companies, excluding those in Australia. Virionyx and other companies in the technology start-up section lobbied loudly for an exemption for New Zealand based companies that might migrate offshore to access capital or markets.
The Taxation (Savings Investment and Miscellaneous Provisions ) Act 2006 was enacted on 19 December 2006 and the company is delighted to advise that the Act contains an exemption which will cover New Zealand resident shareholders in Virionyx !!
In short, the company's NZ resident shareholders will be exempt from the new tax for a period of 10 years post any company migration offshore providing the company maintains a NZ operation which has more than 10 fulltime employees and incurs more than $1 million expenditure per annum. The exact wording of the exemption can be found in section 61 (EX 33 Exemptions: Direct income interests in FIF in grey list country) of the Act.
